Articles of Confederation
In the Articles of Confederation, the national government could not own an army. In
contrast, in the current US constitution, the national government had the right to own and
support armies. Under the Article of Confederation, the national government could declare
war and peace, but they did not own a military. They relied on the state government to
provide soldiers whenever needed (Khan Academy, 2023). This raised a significant concern
as sometimes the state government failed to honor national government requests, and the state
could be at risk. In the current US constitution, the President is the military's Commander-in-
Chief and can declare war.
Under the US constitution, separation of powers is evident in various ways, the
President has the power to appoint government officials, but they can only be approved by
Congress (American Bar Association, 2022). Congress can declare war, but the President is
the military's Commander-in-Chief. The President can nominate federal judges, but the
Senate must confirm the nominations. Separation of powers is designated to prevent any
branch from becoming more powerful than others and prevent abuse of power to maintain
balance in government.
