Process

 
1. Initial Contact: The first step is to establish contact with the parties involved in the dispute. This could be through a phone call, email, or face-to-face meeting.
2. Agreement to Mediate and Payment of Fees: Once the parties agree to proceed with mediation, we sign an agreement to mediate. This document outlines the rules and procedures of the mediation process. At this stage, the parties also pay the agreed-upon mediation fees. All fees must be paid before a mediation date is scheduled. Mediation is intended to take no more than one day, however, if the parties require it, then we would have more than one day to complete. Fees are also determined by the number of days.
3. Submission of Confidential Mediation Brief: Prior to the mediation session, each party submits a confidential mediation brief. This brief outlines their perspective on the dispute and their desired outcome. The brief is typically due at least one week before the scheduled mediation session to allow me time to review.
4. Mediation: I will explain the process of mediation, set expectations, and answer any questions the parties may have. This is also when I gather information about the dispute.
5. Joint Mediation Session: The parties come together in a joint session where each party has the opportunity to share their perspective on the dispute. I facilitate this discussion, ensuring that each party has a chance to speak and be heard.
6. Private Caucus: If necessary, I hold private meetings (caucuses) with each party. This allows parties to share information they may not feel comfortable sharing in the joint session.
7. Negotiation: I help the parties negotiate a resolution to the dispute. This involves identifying common ground, exploring potential solutions, and working towards a mutually acceptable agreement.
8. Agreement: If the parties reach an agreement, I help them put it in writing. This written agreement outlines the terms of the resolution and is signed by all parties.
9. Follow-Up: After the mediation, if requested, I follow up with the parties to ensure the agreement is being adhered to and to address any new issues that may have arisen.
